EVENT ORGANIZER TERMS AND CONDITIONS

MontyBooking (“MontyBooking”, “we”, “our”, or “us”) owns and operates the Website and provides the Services. These Event Organizer Terms and Conditions (the “Terms”) apply to any individual or legal entity that establishes an Account with MontyBooking and accesses or uses any of the Services.

By creating an Account, accessing the Website, listing an event, accepting payments, or otherwise using the Services, you confirm that you have read, understood, and agree to be legally bound by these Terms, the Website Terms of Use, the Privacy Policy, the Data Processing Addendum, the Community Guidelines, and any additional terms and conditions applicable to specific Services that you accept from time to time (collectively, the “Agreement”).

If you do not agree to these Terms, you must immediately discontinue use of the Services.

Unless the context otherwise requires, the following definitions apply:

2.1 These Terms govern the legal relationship between you and MontyBooking and supersede all prior agreements or understandings relating to the Services.

2.2 MontyBooking may require acceptance of additional terms for specific Services. Failure to accept such terms may result in restricted access to those Services.

2.3 If you object to these Terms or any notices published by MontyBooking, your sole remedy is to immediately cease using the Services.

2.4 MontyBooking may amend these Terms at any time to reflect changes in law, regulation, risk management, operational requirements, or Services. Material changes will be notified in advance were reasonably practicable.

2.5 Amended Terms apply prospectively only. Continued use of the Services constitutes acceptance.

2.6 Failure by MontyBooking to enforce any provision does not constitute a waiver.

3. Our Services

3.1 MontyBooking provides a technology platform that enables Event Organisers to manage events and sell tickets.

3.2 MontyBooking does not organize, host, operate, or control events and does not guarantee safety, legality, attendance, or financial success.

3.3 MontyBooking may modify, suspend, or discontinue any part of the Services at any time for operational, technical, security, legal, or commercial reasons.

3.4 You are responsible for ensuring suitable devices, internet access, and system compatibility.

3.5 MontyBooking is not responsible for failures caused by network outages, device malfunction, or third-party interference.

4. Box Office and Hardware

4.1 MontyBooking may supply or rent Hardware to you in connection with Box Office services.

4.2 You assume all risk of loss, theft, or damage to Hardware while in your possession or control.

4.3 You must reimburse MontyBooking for replacement costs and any related expenses.

4.4 You indemnify MontyBooking against all losses, penalties, refunds, or claims arising from Hardware use or misuse.

5. Registration and Account Eligibility

5.1 You must provide accurate, complete, and current information during registration.

5.2 If you are under 18, parental or guardian consent may be required. Users under 13 may not use the Services without verified consent.

5.3 If registering on behalf of an entity, you warrant authority to bind that entity.

5.4 MontyBooking may refuse, suspend, or cancel registration due to incomplete verification, breach, or unacceptable risk.

6. Account Security

6.1 Access to Accounts is limited to Authorized Users.

6.2 You must safeguard credentials and immediately notify MontyBooking of any unauthorized access.

6.3 You are responsible for all activity conducted through your Account.

6.4 MontyBooking is not liable for losses caused by unauthorised access except where caused by its own negligence.

7. Use of Services and Agency Relationship

7.1 You may use the Services solely to manage and operate your events.

7.2 Where payments are processed, MontyBooking acts solely as your limited agent for payment collection.

7.3 All sales contracts are between you and the Customer.

7.4 MontyBooking may modify or restrict Accounts or Content where complaints or breaches arise.

8. Acceptable Use

8.1 You must comply with all applicable laws, Community Guidelines, and these Terms.

8.2 Prohibited conduct includes unlawful, misleading, fraudulent, offensive, or socially unacceptable activity.

8.3 You must not reverse engineer, copy, resell, or misuse the Services.

8.4 MontyBooking may suspend or terminate access pending investigation.

9. Fees and Charges

9.1 Applicable Fees will be disclosed and may be changed for future transactions.

9.2 Fees are non-refundable except where required by law.

9.3 You must not misrepresent Fees to Customers.

10. Funds and Payment Processing

10.1 MontyBooking may collect Funds as your agent and release them according to agreed schedules and risk assessments.

10.2 MontyBooking may require KYC documentation, insurance, event verification, or financial reporting.

10.3 Released Funds must be returned upon request if refund exposure arises.

10.4 If you use a Third-Party Gateway, you remain solely responsible for Funds management and Fees owed.

10.5 Cash handling through Box Office is your sole responsibility.

11. Event Changes, Postponements, and Refunds

11.1 You must promptly notify MontyBooking and Customers of any event changes.

11.2 You are solely responsible for refunds and compliance with consumer protection laws.

11.3 MontyBooking may process refunds as your agent but assumes no liability.

11.4 You indemnify MontyBooking for all losses arising from refunds or event changes.

12. Intellectual Property

12.1 All intellectual property in the Services remains the property of MontyBooking.

12.2 You retain ownership of Your Content but grant MontyBooking a worldwide, royalty-free licence to use it for service delivery and marketing.

13. Privacy and Data Protection

13.1 You must comply with all applicable data protection laws.

13.2 Customer Personal Information may be used solely for event-related purposes.

13.3 You must not send unsolicited marketing without explicit consent.

14. Suspension and Termination

14.1 MontyBooking may suspend or terminate Accounts for breach, fraud, legal risk, reputational harm, or regulatory requirements.

14.2 Termination does not relieve you of outstanding obligations.

14.3 MontyBooking is not liable for losses resulting from suspension or termination.

15. Disclaimer

15.1 The Services are provided on an “as is” and “as available” basis.

15.2 MontyBooking makes no warranties regarding availability, accuracy, reliability, or suitability.

15.3 MontyBooking does not guarantee uninterrupted or secure operation.

15.4 Use of scanning, Box Office, or validation tools is at your own risk.

16. Limitation of Liability

16.1 To the maximum extent permitted by law, MontyBooking shall not be liable for indirect, incidental, or consequential losses.

16.2 Total liability is limited to the lesser of USD 10,000 or Fees paid in the preceding twelve (12) months.

16.3 Claims must be brought up within two (2) years.

17. Indemnity

17.1 You indemnify and hold harmless MontyBooking against all claims, losses, damages, liabilities, and expenses arising from:

18. Relationship of the Parties

18.1 Nothing in these Terms creates a partnership, joint venture, employment, or fiduciary relationship.

18.2 MontyBooking does not assume responsibility for your business operations or regulatory obligations.

19. Assignment

19.1 You may not assign or transfer your Account without MontyBooking’s prior written consent.

19.2 MontyBooking may assign its rights upon notice.

20. Notices

20.1 Notices must be in writing and may be provided electronically.

20.2 Electronic notices are deemed received upon transmission.

21. Severability

If any provision is held invalid or unenforceable, it shall be severed without affecting remaining provisions.

22. No Waiver

Failure to enforce any right does not constitute a waiver of that right.

23. Governing Law and Jurisdiction

These Terms are governed by the laws of Lebanon. The courts of Beirut, Lebanon have exclusive jurisdiction.
