MONTYBOOKING – CUSTOMER TERMS AND CONDITIONS
1. Parties, Purpose and Acceptance
1.1 Platform operator
MontyBooking Pty Ltd ACN 126 987 915 (“MontyBooking”, “we”, “our” or “us”) owns and operates the MontyBooking online platform and provides the customer-facing services described in these Customer Terms and Conditions.
1.2 Customers
These Terms apply to any individual or entity that accesses or uses the Website or Services in any manner, including viewing event listings, creating an account, registering for an event, purchasing tickets, making payments, or submitting donations in connection with an event made available by an Event Organizer (“Customer”, “you”, “your”).
1.3 Binding agreement
By accessing or using the Website or Services in any way, including browsing content or completing a transaction, you enter into a legally binding agreement with MontyBooking and agree to comply with: (a) these Customer Terms and Conditions; (b) the Website Terms of Use; (c) the Privacy Policy; and (d) any additional terms, notices, or rules displayed in connection with a specific Service or event (collectively, the “Platform Terms”).
1.4 Non-acceptance
If you do not agree to the Platform Terms, you must immediately discontinue access to and use of the Website and Services.
1.5 Legal capacity
You confirm that you have legal capacity to enter into these Terms, including meeting any minimum age requirements applicable in your jurisdiction, or that you have obtained valid parental or guardian consent where required.
2. Definitions
In these Terms (unless the context indicates otherwise):
2.1 Account means an Event Organizer account created with MontyBooking (whether online or otherwise) to list events and use platform tools.
2.2 Customer / you mean any person who accesses the Website or uses the Services, whether the person completes a transaction.
2.3 Event Organizer means any person or entity that creates an Account to publish events or activities, manage registrations/bookings, sell tickets, and/or request or receive donations through the Website.
2.4 Person includes an individual, company, partnership, trust, association, joint venture, government body, or any other legal or incorporated entity.
2.5 Personal Information and Sensitive Information have the meanings assigned in the Privacy Policy.
2.6 Privacy Policy means the privacy policy published on the Website and updated from time to time.
2.7 Services means the customer-facing services made available through the Website, including event browsing, registration, booking, ticket purchasing, payment facilitation, donation processing (where enabled), ticket delivery, and other related services offered by us from time to time.
2.8 Third Party Content means any websites, platforms, information, services, goods, software, or content owned or supplied by third parties, including materials accessible via links.
2.9 Website means https://www.montybooking.com including any subdomains, password-protected areas, related domains, mobile sites, apps, APIs, widgets, and any successor or replacement domains.
2.10 Website Terms of Use means the Website terms of use published by us and amended from time to time.
2.11 Interpretation. Headings are for convenience and do not affect meaning. Words like “including” and “for example” are not limiting.
3. About These Terms (Entire Agreement; Updates; Priority)
3.1 Entire understanding. The Platform Terms represent the complete agreement between you and MontyBooking regarding your use of the Website and Services and replace any prior discussions, statements, representations, or earlier versions of terms.
3.2 Service-specific terms. Certain features (for example, donations, promotions, special ticket types, installment options, or access-controlled events) may have additional conditions. Where those additional conditions apply, you agree to comply with them.
3.3 Updates and changes. We may amend these Terms by publishing a revised version on the Website. Changes may be required due to: (a) legal or regulatory developments; (b) changes to our security controls or risk processes; (c) the introduction, removal, or modification of Services; or (d) operational needs.
3.4 Effect of continued use. If you keep using the Website or Services after updated Terms are published, you are treated as having accepted the updated Terms. If you do not accept the updated Terms, you must stop using the Website and Services.
3.5 Which terms prevail. If there is a genuine inconsistency between: (a) these Terms; (b) any additional service-specific terms; and/or (c) the Website Terms of Use, the order of priority is: (i) the service-specific terms (for that Service only), then (ii) these Terms, then (iii) the Website Terms of Use, unless we expressly state otherwise.
3.6 No waiver. If we do not enforce a right immediately, we still keep that right and may enforce it later.
4. Event Organizer Rules (Additional Terms for Events)
4.1 Organizer policies may apply. Event Organizers may set conditions for their events, including entry requirements, refund rules, rescheduling/cancellation policies, age limits, venue rules, prohibited items, and conduct standards.
4.2 Your responsibility to review. You must read and understand the Event Organizer’s conditions before purchasing tickets, registering, booking, or making a payment/donation.
4.3 Our non-party status. You acknowledge that MontyBooking is not a party to the separate arrangement between you and the Event Organizer in relation to the event itself, except to the extent we facilitate the platform transaction as described in these Terms.
4.4 No obligations created for us. Event Organizer terms do not: (a) impose duties on us; (b) make us responsible for the event; or (c) provide you with rights against us.
5. What MontyBooking Does (Platform Role; Agency; No Endorsement)
5.1 Technology marketplace. The Website is a technology platform that allows Event Organizers to publish events and allows Customers to purchase tickets or register/book via the platform.
5.2 Event pages. Event Organizers create and manage their own listings, descriptions, schedules, and ticketing settings. Information displayed for an event is provided by the Event Organizer unless we state otherwise.
5.3 Transactions are with the Organizer. Unless expressly stated, the event contract (including attendance, admission, and event delivery) is between you and the Event Organizer. We do not host or produce events and do not control the venue.
5.4 Limited role as facilitator. We may act as a disclosed intermediary for processing and administration (e.g., payment flow, issuing e-tickets, providing access tools), but this does not mean we become the event operator.
5.5 No event responsibility. To the maximum extent permitted by law, we are not responsible for: (a) event delivery, quality, safety, or legality; (b) venue conditions, security decisions, seating allocations, or entry refusals; (c) cancellations, postponements, changes, or disputes; or (d) refund decisions (which remain with the Event Organizer) except where we are legally required to do otherwise.
5.6 Donations and fundraising. If donations are enabled, you understand and agree that: (a) any appeal, cause description, or statements are made by the Event Organizer; (b) we do not verify or endorse the Event Organizer, its purposes, or the use of donation proceeds; and (c) any dispute about a donation is primarily between you and the Event Organizer, subject to mandatory laws and payment-network rules.
6. Your Use of the Website and Services (Accuracy; Tickets; Controls)
6.1 Accurate information. Any details you submit (including name, email, phone number, and payment information) must be correct and complete. You are responsible for updating or correcting details where needed.
6.2 Ticket terms. You acknowledge that tickets and entry are subject to: (a) Event Organizer conditions; and/or (b) venue rules and lawful directions of security and staff.
6.3 Pricing and availability are Organizer-controlled. Ticket prices, ticket types, quotas, and promotional codes are set by the Event Organizer. We do not set prices unless clearly stated for a specific event.
6.4 Pricing mistakes and technical errors. If an order is affected by a clear pricing error, system malfunction, duplicated order, or processing anomaly, we may cancel the order and (where appropriate) return the amount paid for that order in accordance with these Terms and any applicable law.
6.5 Access control. We may restrict, suspend, or revoke access to the Website (in whole or in part) where we reasonably believe this is necessary for security, fraud prevention, compliance, system stability, or enforcement of these Terms.
7. Acceptable Use (Security; Restrictions; Prohibited Behavior Online)
7.1 Proper use. You must use the Website and Services only in a lawful, respectful, and non-abusive manner and must not attempt to interfere with the normal operation of the platform.
7.2 Prohibited activities. You must not, and must not help others to: (a) upload or publish unlawful, defamatory, hateful, obscene, fraudulent, or deceptive material; (b) disrupt the Website by overloading it, probing it, or interfering with its security measures; (c) scrape, crawl, or harvest data using automated tools (including bots, robots, and spiders); (d) reverse engineer, decompile, or attempt to extract source code or platform logic; (e) reproduce, distribute, or republish Website content except for ordinary personal use required to complete a transaction; (f) circumvent purchase limits or attempt bulk purchasing through automation; (g) request excessive pages or make high-frequency transactional requests that harm platform performance; (h) use the Website to derive unrelated commercial benefit (spam, advertising, affiliate redirection) outside the scope of the relevant event; or (i) engage in any activity that compromises customer data, ticket security, or payment security.
7.3 Action on violations. If we receive a complaint or detect suspicious activity, we may: (a) temporarily suspend access while we investigate; (b) cancel affected orders where justified; and/or (c) terminate access for serious or repeated breaches.
8. Payments, Fees, Currency and Taxes
8.1 Secure processing. Card and online payments are processed using secure payment systems and providers.
8.2 Fees at checkout. Transactions may include a booking/service/admin/processing fee per order, which may be shown separately or embedded in the total payable amount depending on the Event Organizer’s configuration.
8.3 Fee changes. Fees may change over time. The fees displayed during checkout apply to that order.
8.4 Currency. Unless stated otherwise, prices are displayed in USD.
8.5 Taxes and charges. Unless we state that a price is “tax included”, taxes or government charges (if applicable) may be added in accordance with local requirements or the Event Organizer’s obligations.
8.6 Payment gateway. We may offer online payments via MontyPay or other providers. Payment processing may be subject to provider checks, anti-fraud controls, and network rules.
9. Event Changes (Postponement, Variation, Cancellation)
9.1 Organizer responsibility. Event changes (including schedule adjustments, venue changes, postponements, or cancellations) are decided by the Event Organizer and remain the Event Organizer’s responsibility.
9.2 No guarantee of notice. We do not guarantee that Customers will be informed of changes before the event date. It remains your responsibility to check event updates through the Organizer’s channels or the Website listing.
9.3 Sharing contact information for event updates. To help the Event Organizer provide event-related updates, we may share your contact details with the Organizer as described in the Privacy Policy.
9.4 No unsolicited marketing permission. Event Organizers are not permitted to add you to marketing lists unless you actively opt-in during checkout or registration, subject to applicable law.
10. Exchanges and Refunds (Platform vs Organizer)
10.1 No exchange obligation by us. Unless required by law or explicitly stated, we do not exchange tickets or provide refunds for event cancellations, changes, dissatisfaction, or missed attendance.
10.2 Organizer refund rules control. Any decision about a ticket refund, credit, exchange, or substitution is made by the Event Organizer under its policies, subject to mandatory consumer laws.
10.3 Platform fees generally non-refundable. To the maximum extent allowed by law, booking/service/admin/processing fees charged in connection with an order are not refundable, even if an Event Organizer refunds the ticket price.
11. Ticket Transfer and Resale
11.1 No unauthorized resale. Tickets are intended for personal use and must not be resold for profit or used for commercial resale unless the Event Organizer explicitly permits it and it is lawful.
11.2 Misuse and invalidation. Tickets may be cancelled or invalidated (without refund) where we reasonably suspect: (a) scalping or unauthorized resale; (b) duplication, tampering, counterfeiting, or manipulation of QR/barcodes; (c) use of a ticket that has already been scanned or voided; or (d) acquisition of a ticket through a breach of these Terms.
11.3 Transfers only if enabled. If the Event Organizer enables transfers, tickets may be transferred only through Monty Booking’s transfer functionality and only free of charge.
11.4 Transfer disputes. We are not responsible for disputes between users relating to transfers, whether transfers occur on or off the platform.
12. Ticket Delivery
12.1 Electronic issuance. Tickets are typically issued electronically via email and/or your account on the Website unless otherwise stated for a particular event.
12.2 Customer responsibility. You must ensure your email address and other contact details are correct and that your mailbox can receive messages (including checking spam/junk folders).
12.3 Timing. Ticket delivery may occur immediately or within a reasonable period after payment confirmation, depending on Organizer settings, fraud checks, and system availability.
12.4 Delivery limitations. We are not responsible for non-receipt caused by incorrect details, email filtering, device issues, or third-party outages.
12.5 Ticket security. You should keep tickets confidential and not share barcode/QR images publicly. Entry may be granted to the first person presenting a valid scannable ticket, and we are not responsible for losses caused by sharing.
13. Customer Conduct and Responsibilities (In-Person Behavior)
13.1 Expected standards. Customers and their guests must behave responsibly and respectfully, comply with staff/security instructions, and follow safety procedures.
13.2 Prohibited conduct. Behavior that is disruptive, threatening, abusive, discriminatory, unsafe, or illegal may result in refusal of entry or removal without refund, as determined by the Organizer and/or venue.
13.3 Damage. You are responsible for damage caused by you or your guests to venues, equipment, furnishings, or property and may be charged for repairs or replacement.
13.4 No interference. You must not interfere with performers, staff, security, or event operations, including ignoring emergency procedures.
14. Venue Rules
14.1 Compliance. You must comply with venue rules and Organizer rules, including age restrictions, ID requirements, seating/access rules, prohibited items, and crowd control measures.
14.2 Updates. Rules may be adjusted by the Organizer/venue for safety, capacity, or operational reasons. You are responsible for following the applicable rules at the event’s time.
14.3 Enforcement. Failure to comply may result in denied entry or removal, in line with Organizer policies.
15. Intellectual Property
15.1 Our materials. The Website and its content (including branding, text, graphics, layouts, software, and features) are owned by or licensed to us.
15.2 Limited permission. You receive limited, revocable, non-transferable permission to access and view the Website solely for personal use necessary to use the Services.
15.3 Restrictions. You must not reproduce, adapt, distribute, publish, frame, or commercially exploit Website materials without our prior written consent, except were permitted by law.
15.4 Reservation. All rights not expressly granted are reserved.
16. Third Party Content
16.1 Links and third-party materials. The Website may contain Third Party Content and links to third-party sites or services.
16.2 No responsibility. We do not control or guarantee Third Party Content and are not responsible for its accuracy, safety, legality, or availability.
16.3 As available. Third Party Content is provided “as is” and “as available”, and your use is at your own risk.
16.4 Removal. We may remove or disable access to Third Party Content if we reasonably believe it violates law or these Terms.
17. Privacy and Data
17.1 Use of information. We collect, use, store, and share Personal Information (including Sensitive Information where applicable) as described in the Privacy Policy to operate the Website, process transactions, deliver tickets, and support Services.
17.2 Organizer access. To enable event administration and communication, Event Organizers may receive relevant Customer information for their events.
17.3 Consent withdrawal. If you withdraw consent or request erasure of data (where lawful), your ability to access Services (including retrieving tickets) may be restricted.
18. Suspension or Termination
18.1 When we may act. We may suspend or end your access to all or part of the Website/Services if we reasonably believe you: (a) breached these Terms; (b) misused the Website/Services; (c) created fraud, security, or compliance risk; or (d) exposed us or others to legal liability.
18.2 Notice. Where reasonable, we may provide notice, but we may act immediately for security or legal reasons.
18.3 No liability. We are not liable for suspension/termination actions taken in accordance with these Terms.
19. Disclaimers
19.1 No warranties. Except where law requires otherwise, the Website and Services are provided without warranties and on an “as available” basis.
19.2 Availability. We do not promise continuous or uninterrupted access and do not guarantee that Services will be error-free or secure at all times.
19.3 External disruptions. Outages may occur due to factors outside our control (network failures, provider outages, maintenance, etc.).
19.4 Viruses and security. We cannot guarantee downloads are free from harmful components or that systems are immune from unauthorized access.
19.5 Data issues. We are not responsible for loss or corruption of data entered or uploaded by you or an Organizer.
20. Force Majeure
We are not responsible for failure or delay caused by events outside our reasonable control (including natural disasters, war, civil unrest, strikes, internet/provider outages, or government measures).
21. Limitation of Liability
21.1 Exclusion. To the maximum extent permitted by law, we and our related parties will not be liable for indirect, incidental, special, or consequential losses, including lost profits, loss of goodwill, or loss of opportunity.
21.2 Cap. Subject to non-excludable legal rights, our total liability for claims relating to the Website/Services will not exceed the lesser of: (a) amounts paid by you to us in the 12 months before the claim; and (b) USD 10,000.
21.3 Time limit to bring claims. You agree not to bring a claim more than two (2) years after the cause of action arises.
22. Indemnity
You agree to compensate us for losses and costs (including reasonable legal fees) arising from or connected with: (a) your breach of these Terms; (b) misuse of the Website/Services; or (c) infringement of third-party rights caused by your conduct.
23. Survival
Provisions that by their nature should survive termination shall survive, including liability limitations, indemnities, and intellectual property protections.
24. Severability
If any part of these Terms is found invalid or unenforceable, that part will be removed to the minimum extent required, and the remainder will continue in effect.
25. No Waiver
If we do not enforce a right immediately, that does not mean we give up that right.
26. Governing Law and Courts
These Terms are governed by the laws of Lebanon, and disputes are subject to the exclusive jurisdiction of the courts of Beirut, Lebanon.
